Terms & Conditions: User Content Ownership


I am new to Insightly, and I am impressed about what can be done with it. However, before putting all my sensitive information onto it, I was checking the Terms & Conditions of the Service:

After reading it, and going through point 8 regarding "Content Ownership", I was a bit concerned about what is stated in point a), and I paste it here:

(a) Rights in User Content Granted by You. By making any User Content available through the Services you hereby grant to Insightly a non-exclusive, transferable, worldwide, royalty-free license, with the right to sublicense, to use, copy, modify, create derivative works based upon, distribute, publicly display, publicly perform and distribute your User Content in connection with operating and providing the Services and Content to you and to other Account holders.

So, correct me if I am wrong, but it looks to me that these terms give my permission to make use of the content I upload in a very broad manner.

Please, I would really appreciate it if someone could clarify this.

    Hi Everyone, 

    At it simplest form, the purpose of that clause is to ensure we can help service you. We need this in order to upload your data to our servers, back it up, secure it and transmit it to your session on both computers and mobile devices. Without those rights, we couldn’t offer our Services.

    It's also worth sharing that at the top of Section 8, we have the clause -- Insightly does not claim any ownership rights in any User Content and nothing in these Terms will be deemed to restrict any rights that you may have to use and exploit your User Content.

  • Excellent topic... I would like to learn more about this. 

    We upload data that are sensitive data of our clients.. a bank account number for example.

    Does it mean that Insightly can use or disseminate that information as they see fit?

    Also, can they use the names of our clients or use their emails to contact them?
